1. Acceptance of Terms

These Terms of Service are an agreement between you and OttoClipper LLC ("OttoClipper", "we", "us"). They cover the OttoClipper browser extension ("the Extension"), the website at ottoclipper.com, and the deals site at deals.ottoclipper.com with its Telegram channel ("the Deals Site"), together "the Service". By installing, accessing, or using any of them, you agree to be bound by these Terms. If you do not agree to these terms, do not use the Service.

The Service is offered only to people in the United States. If you use it from elsewhere, you do so on your own initiative and are responsible for following your local laws. These Terms should be read together with our Privacy Policy.

2. Important Disclaimers

YOU ASSUME ALL RESPONSIBILITY AND RISK for your decision to use this Extension. OttoClipper provides this tool "as is" and makes no guarantees about its compatibility with any store's policies or systems.

3. Description of Service

OttoClipper is a browser extension that helps users clip digital coupons on supported retail websites. The Extension automates the process of clicking coupon buttons that would otherwise be clicked manually by the user.

4. User Responsibilities

You agree to:

• Use the Extension only on accounts you own or have authorization to access
• Review and comply with each store's terms of service
• Accept full responsibility for any consequences of using the Extension
• Not use the Extension for any illegal purpose
• Not attempt to reverse engineer, modify, or circumvent any security features

5. Accounts, Plans and Subscriptions

Eligibility

You must be at least 13 years old to use OttoClipper, and you confirm this when you create an account. You must be at least 18 years old, or the age of majority where you live if that is higher, to buy OttoClipper Pro, and you confirm this before checkout. You must live in the United States to use the Service.

Free use and accounts

You can run the Extension on one store without an account; for that run we create an anonymous account for your installation of the Extension. To keep using the Extension you need a free OttoClipper account, created with an email address and password. If you create one after your first run, that run's history is kept in your new account. You are responsible for keeping your account credentials confidential.

A free account can clip up to 4 stores a day and keep one Clip Profile of up to 2 stores. We may change what the free plan includes; we will not reduce what a paid plan includes during a period you have already paid for.

OttoClipper Pro

• Pro costs $4.99 a month (billed monthly) or $45 a year (billed yearly), in US dollars. Sales tax, where it applies, is added at checkout by Link, the seller of record for new Pro subscriptions.
• Pro renews automatically at the end of each billing period, and your payment method is charged the then-current price, until you cancel.
• You can cancel at any time from your Account page (Manage Subscription). Cancelling stops future renewals; you keep Pro until the end of the period you have paid for, and, apart from the 7-day refund below, we do not refund partial periods except where the law requires it or at our discretion.
• 7-day refund. If you ask within 7 days of your first Pro payment, we will refund that payment in full. To ask, email [email protected] from the address on your account. This applies to your first payment only, not to renewals.
• You can switch between monthly and yearly billing from Manage Subscription. Moving to yearly starts immediately, with credit for the unused part of your month; moving to monthly takes effect when your paid year ends.
• If a renewal payment fails, we and our payment processor retry it for a limited time and you keep Pro while we do. If it still fails, your subscription is cancelled and your account moves to the free plan.
• We will tell you by email before any price change applies to your subscription, and you can cancel before it does.
• Pro is available only with a United States billing address. We may cancel and refund a subscription purchased with a billing address outside the United States.
• New Pro subscriptions are sold through Link, a Stripe service: Link is the seller shown at checkout and on your card statement, and it handles payments, receipts, refunds and disputes. We do not receive your full card number.

Free trial

• New Pro subscribers may be offered a 14-day free trial of the monthly plan, or a 30-day one if they joined through a referral (see section 6). You must add a payment method to start it. Nothing is charged during the trial.
• Unless you cancel before the trial ends, your payment method is charged $4.99 when the trial ends and $4.99 every month after that until you cancel. We email you before the trial ends with the date of the first charge, the amount and a link to cancel. If you cancel during the trial, you are not charged.
• The trial is limited to one per person. It is not available to anyone who has had Pro or a trial before, including through another account, email address or payment method. We may cancel a trial that does not meet these conditions before any charge is made.

6. Referral Program

• Someone new to OttoClipper who creates an account using your referral link (a "referred friend") can be offered a 30-day free trial of Pro instead of 14 days, on the terms in section 5: a payment method is required, it converts to $4.99 a month unless cancelled, and it is limited to one trial per person.
• Paid friends. When a referred friend becomes a paying Pro subscriber and their first payment goes through, you receive one free month of Pro. If you have a Pro subscription that renews, the free month is a credit of $4.99 applied to your next Pro payment (on the yearly plan, $4.99 off your next renewal); otherwise it is 30 days of Pro, added after any Pro you already have. Only a friend's first payment counts, and you can receive at most 12 free months in any 12 months. If that payment is refunded or disputed, we take back the free month if it has not been used; a free month taken back still counts towards the yearly limit.
• Active friends. When a referred friend completes clip runs that clip at least one coupon in two different weeks, your free plan permanently gains one more store a day, up to 8 stores a day in total. If you have Pro at the time, the extra stores apply whenever you are on the free plan.
• Referral codes can only be used on new accounts. A person counts as an active friend only once, however many accounts they create.
• Referrals between accounts that belong to the same person, or that share a device, payment method or other signals indicating the same person, do not count. We may withhold or remove rewards obtained by abusing the program.
• Rewards have no cash value and cannot be transferred. We may change or end the program at any time; rewards already earned will be honoured.

7. Deals Site

The Deals Site lists offers from stores. Most are found automatically on established deal sites and written up by our system; some are picked by our team.

• Prices, availability, codes and conditions are set by each store and can change or end without notice. We try to keep listings accurate, but we do not guarantee that any price, code or deal is current or correct. Check the final price at the store before you buy.
• We are not the seller. Any purchase is between you and the store, under the store’s terms; questions about orders, shipping, returns or refunds go to the store.
• Some links are affiliate links, and we may earn a commission when you buy through them, at no extra cost to you. See the Affiliate Disclosure.

8. Intellectual Property

OttoClipper and its original content, features, and functionality are owned by OttoClipper LLC and are protected by international copyright, trademark, and other intellectual property laws.

9. Your Feedback and Reports

If you send us feedback, an idea or a problem report, you let us use it to improve the Service without paying you or crediting you. You keep ownership of anything you send that is yours; we need only the right to use it in the Service.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OTTOCLIPPER LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Service
• Any actions taken by stores or websites in response to your use of the Extension
• Any deal, price or listing on the Deals Site, or any purchase you make from a store
• Any unauthorized access to or alteration of your data
• Any other matter relating to the Service

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) $100 AND (B) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AROSE. SOME STATES DO NOT ALLOW CERTAIN LIMITS ON DAMAGES OR WARRANTIES, SO PART OF THIS SECTION AND SECTION 11 MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW.

11. Disclaimer of Warranties

THE SERVICE, INCLUDING THE DEALS SITE AND ITS LISTINGS, IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Indemnification

You agree to defend, indemnify, and hold harmless OttoClipper LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to your use of the Service or violation of these Terms.

13. Changes to Terms

We may change these Terms. We will update the date at the top of this page. For a material change we will tell you by email or in the Extension or website before it takes effect. If you keep using the Service after that, you accept the change; if you do not accept it, stop using the Service. A change does not increase what you pay for a period you have already paid for.

14. Termination

You may stop using the Service at any time, and you can delete your account as described in the Privacy Policy. We may suspend or end your access to the Service, with or without notice, if you break these Terms, if the law requires it, or if we stop offering the Service. When your access ends, your right to use the Service ends. Sections that by their nature should continue (including 2, 9, 10, 11, 12 and 15) continue after termination.

15. Governing Law and Disputes

These Terms and any dispute about them or the Service are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws rules. Any lawsuit must be brought in the state or federal courts serving Blair County, Pennsylvania, and you and we consent to those courts. Either of us may bring a case in small claims court if it qualifies, and we may ask any court for an order to stop misuse of our intellectual property. Nothing here takes away rights you have under the consumer protection laws of your state that cannot be waived.

16. General

These Terms and the Privacy Policy are the whole agreement between us about the Service. If a part is found unenforceable, the rest stays in effect. If we do not enforce a part, that is not a waiver of it. You may not transfer your rights under these Terms without our consent; we may transfer ours as part of a sale or reorganization of our business. You agree we may give notices by email or by posting them in the Extension or website.
